# Terms of Service – Archive Master
**Effective Date**: July 21, 2026
This Terms of Service Agreement (“Agreement”) is a legally binding contract between you (the “User”, “you”, or “your”) and the operators of **Archive Master**: namely, **Ashish Dungdung** (the “Owner”), **Ash Digital Services** (the “Operator” or “Manager”, a registered sole proprietorship business entity under GST), and **DazeStack** (the “Brand”). The Owner, Operator, and Brand are collectively referred to as “we”, “us”, or “our” within this Agreement.
Please read this Agreement carefully before using Archive Master. By downloading, installing, accessing, or using the Software (the “App” or “Software”), you agree to be bound by the terms and conditions set forth herein. If you do not agree to all terms of this Agreement, you are not authorized to install, access, or use the Software.

## 1. Ownership, Intellectual Property, and Operational Architecture
### 1.1 Intellectual Property Ownership
**Ashish Dungdung** is the sole owner and copyright holder of all intellectual property, copyright, source code, designs, patents, trademarks, and proprietary interests in and to Archive Master. All rights not explicitly granted to you under this Agreement are reserved exclusively by the Owner.
### 1.2 Branding and Consumer Representation
The Software is marketed, branded, and presented to the public under the proprietary trade name and brand **DazeStack**. All brand identity, logos, websites, and promotional materials associated with the DazeStack brand are protected by intellectual property laws and are the property of the Owner.
### 1.3 Operations, Management, and Licensing Entity
All commercial distribution, administrative management, transaction processing, and user licensing are managed and operated exclusively by **Ash Digital Services**, a registered sole proprietorship business entity (GST-registered). Ash Digital Services acts as the sole authorized manager and commercial licensee of the Software.
### 1.4 End-User License Grant
Subject to your strict compliance with this Agreement, you are granted a non-exclusive, worldwide, royalty-free, non-transferable license to use, copy, modify, and distribute the Software, subject to the conditions of the **MIT License**. The text of the MIT License is incorporated herein by reference.

## 2. Privacy and Data Security
Your privacy is paramount. Archive Master operates as a local utility:
* All compression, extraction, and archiving processes occur strictly on your local device.
* We do not collect, monitor, transmit, or store any personal data, file metadata, or file content.
* Any optional crash reporting or diagnostics you share are processed through Apple’s standard developer feedback mechanisms and are subject to Apple’s Privacy Policy.

## 3. Automation and Destructive Features Disclaimer
Archive Master contains optional, user-activated automated features, including but not limited to **”Delete original files after compression”** and **”Delete archive after extraction”** (collectively, “Automation Features”).
> **Data Loss Risk**
> By enabling any Automation Feature, you expressly acknowledge and agree that:
> * These features perform permanent or semi-permanent file deletion operations.
> * While Archive Master is configured to use native macOS Trash APIs (moving files to the system Trash rather than immediate deletion) when possible, we make no representation, warranty, or guarantee that deleted files will remain restorable.
> * You bear the sole and absolute responsibility to maintain independent, secure, and up-to-date backups of all critical files and data prior to utilizing these features.
> * None of the operators (including Ashish Dungdung, Ash Digital Services, and DazeStack) shall be liable for any accidental loss, deletion, or corruption of data resulting from your activation or use of these features.

## 4. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
ASHISH DUNGDUNG, ASH DIGITAL SERVICES, AND DAZESTACK DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that:
* The Software will meet your requirements.
* The operation of the Software will be uninterrupted, secure, or error-free.
* The results obtained from using the Software will be accurate or reliable.
* Any archives created or extracted using the Software will be free from corruption, data loss, or integrity defects.

## 5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASHISH DUNGDUNG, ASH DIGITAL SERVICES, DAZESTACK, OR THEIR FOUNDERS, OFFICERS, AGENTS, CONTRIBUTORS, OR COPYRIGHT HOLDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU (IF ANY) TO US FOR THE USE OF THE SOFTWARE.

## 6. Indemnification
You agree to indemnify, defend, and hold harmless Ashish Dungdung, Ash Digital Services, DazeStack, and their affiliates, officers, agents, and contributors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:
1. Your use or misuse of the Software.
2. Your breach of this Agreement.
3. Your violation of any third-party rights (including intellectual property or privacy rights).

## 7. Third-Party Libraries and Open Source Attribution
Archive Master utilizes several highly optimized open-source libraries for its core compression and archive engine, including but not limited to:
* **libarchive** (Multi-format archive and compression library)
* **zstd** (Zstandard compression algorithm)
* **lz4** (Fast compression algorithm)
* **xz / liblzma** (Lempel-Ziv-Markov chain-Algorithm compression)
These libraries are included under their respective open-source licenses. Use of these libraries is governed by their respective license terms, and nothing in these Terms restricts your rights under those open-source licenses.

## 8. Governing Law and Dispute Resolution
This Agreement, and any dispute or claim arising out of or in connection with it or its subject matter, shall be governed by, and construed in accordance with, the laws of India, without reference to its conflict-of-law principles.
Any legal suit, action, or proceeding arising out of or related to this Agreement or the Software shall be instituted exclusively in the competent courts located in India, and you hereby consent to the personal jurisdiction and venue of such courts.

## 9. Changes to This Agreement
We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. When we make updates, we will revise the “Effective Date” at the top of this document. Your continued use of the Software following the posting of any changes to this Agreement constitutes acceptance of those changes.
